Refunds & Returns Policy

Construction Chemicals & Specialist Products
(Aligned with the South African Consumer Protection Act, 68 of 2008)

1. Application of This Policy
This policy applies to the supply of construction chemicals, specialist coatings, mortars, resins, sealants, and associated products.

Where the customer is a juristic person with an annual turnover or asset value above the CPA
threshold, the transaction may fall outside the scope of the CPA.
Where the CPA applies, this policy is intended to comply with its requirements.

2. General Commercial Position
Due to the technical, chemical, and safety-critical nature of our products:
• Returns are not automatically accepted
• Products cannot be resold once opened, used, mixed, or contaminated
• All returns are subject to prior written approval
Customers are encouraged to confirm product suitability before ordering.

3. Incorrect or Damaged Goods
We will gladly replace or refund products where:
• Incorrect goods were supplied, or
• Goods delivered by VERNi were damaged in transit
Conditions:
• Must be reported within 48 hours of delivery
• Product must be unused and in original packaging
• Delivery documentation and photos must be supplied

4. CPA Cooling-Off (Where Applicable)
In terms of the CPA, where a transaction qualifies:
• The customer may return goods within 10 business days of delivery
• Goods must be unused, unopened, and in original condition
• The customer bears return transport and handling costs
• A reasonable handling/restocking charge may apply
This cooling-off right does not apply to:
• Made-to-order products
• Custom formulations, tinted or modified products
• Products supplied for a specific project or site
(as permitted under the CPA).

5. Non-Returnable Products
The following products are non-returnable and non-refundable:
• Opened, partially used, mixed, or decanted products
• Custom-manufactured or project-specific products
• Pigmented, tinted, or modified products
• Products incorrectly stored or past shelf life
• Products supplied and taken to site
• Discounted or clearance stock

6. Defective Products
Where a defect is alleged:
• The product will be assessed as per CPA requirements
• Batch samples and technical data may be reviewed
• Application method, substrate condition, and environmental factors may be requested
If a manufacturing defect is proven, we will, at our discretion:
• Replace the product, or
• Refund the purchase price
Failure to follow the Technical Data Sheet (TDS), incorrect application, or unsuitable site
conditions do not constitute product defects.

7. Approved Returns & Credits
Where a return is approved (excluding confirmed defects or supply errors):
• A restocking/handling fee of up to 20% may apply
• Transport costs remain the customer’s responsibility
• Goods must be returned within the agreed timeframe
Credits or refunds are processed only after inspection of returned goods.

8. Refund Method
• Refunds are issued to the original purchaser only
• Refunds may be processed as a credit note
• No cash refunds
• Processing time: 7–14 working days

9. Order Cancellations
• Cancellations must be submitted in writing
• Orders already manufactured, tinted, dispatched, or committed to raw materials cannot
be cancelled
• Cancellation charges may apply depending on production status

10. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to:
• Replacement of the product, or
• Refund of the purchase price
We do not accept liability for:
• Labour or application costs
• Project delays or downtime
• Consequential or indirect losses

11. Acceptance
By placing an order, the customer confirms acceptance of this Refunds & Returns Policy
